I would like to leave my accommodation, what do I have to do?
To rent my accommodation I had to sign a lease contract with my lessor.
To leave my accommodation I have to terminate in writing my contract. How does it work?
On my lease contract I will find all information which I need, like for example the termination deadline and the next possible term of termination.
The ordinary termination
If I do not want to be responsible anymore for my accommodation beyond the next term of my lease contract, I have to comply with the delay of termination mentioned in my lease contract.
The delay of termination has not exceeded and the next term of termination suits me? Perfect! I will end my lease contract with an ORDINARY termination. I send a written notification letter for the next term to my lessor with my signature, by registered mail.
The early termination
The next possible term mentioned in my lease contract does not suit me and I would like to leave the accommodation earlier. Is it possible?
Yes, but in that case it will be an EARLY termination. I send a written notification letter for the requested date to my lessor with my signature, by registered mail. At the same time or just after it, I propose minimum one solvent successor to my lessor who wants to sign a lease contract at the same conditions as me. It is up to me to find a successor (advertisements, visits, list of interested persons with name and contact details). My lessor also has to favor the re-rental and has to propose the accommodation to interested persons.
Has my lessor to accept the proposed successor?
My lessor controls if the proposed successor responds to the rental conditions and if he is solvent. If he does not accept a proposed successor filling the conditions, he has to release me from my contractual obligations for the desired date. If my lessor has another applicant, he can favor him.
In which delay do I have to propose a successor?
Generally, the delay is one month for the 15th or the last day of the month because the lessor needs time to analyze the applications and to carry out the administrative procedures.
What happens if I do not find any successor or if my successor is not accepted?
I will stay responsible until the date for which another successor could sign a contract, but at the latest until the term of my contract.
I found a successor which I proposed but he moved over, am I responsible?
As long as the candidate has not signed the contract I stay responsible of the lease contract and I have to find another candidate.
